Customer-Supplied Garment Liability Waiver

By signing below, I agree that Northwest Custom Apparel (NWCA), 2025 Freeman Rd. E., Milton, WA 98354, will decorate garments I am supplying, on the terms set out here.

1. What I am supplying. The garments in this order were not purchased through NWCA. NWCA cannot verify their quality, fabric content, construction, or whether they are suited to the decoration method I have chosen (embroidery, screen printing, DTF / heat transfer, laser engraving, or patches). I accept that risk.
2. Production mishaps are my risk. Decorating an unfamiliar garment can go wrong in ways no shop can fully control. NWCA is not responsible for uncontrollable manufacturing mishaps, including broken needles, thread or needle damage, hoop or hooping marks, machinery malfunctions, dye migration, scorching or heat-press marks, puckering, misalignment caused by garment construction, ink or adhesive behavior on unknown fabrics, shrinkage, or other production-related issues.
3. NWCA's liability is capped at the decoration charge. If an item is misprinted or damaged, the most NWCA will owe me is the cost of the decoration service for that item — for example, the embroidery charge on one jacket. NWCA will not replace the garment, refund its purchase price, or compensate me for its value, regardless of what I paid for it.
4. Normal spoilage allowance (3%). Some loss is normal in production. For every 100 pieces, up to 3 may be misprinted or damaged with no credit due. Credits per NWCA policy, subject to the limit in clause 3, apply only to misprinted or damaged pieces above that allowance.
5. Inspect and report within 7 days. I will inspect the order at pickup or delivery. Issues I raise within 7 days of pickup are eligible for credit under NWCA's policy. Claims made after 7 days are not eligible.
6. Pre-existing condition. At intake NWCA will note any stains, holes, wear, or manufacturing defects on my garments and may photograph them, so there is a record of how they arrived.
7. Count of record. I will count my garments carefully before leaving them. NWCA verifies the count at receiving, and the receiving count is the count of record.
8. Extras. NWCA recommends I supply extra garments — at least one per style and color — for test sews and normal spoilage. Extras that are not used will be returned to me.
9. Clean garments and scheduling. Garments must arrive clean; NWCA may decline soiled or damaged items. Production scheduling begins once all garments have been received and counted.
10. Governing law. This waiver is governed by the laws of the State of Washington.

Electronic signature. I agree that typing my name, optionally drawing my signature, checking the consent box and clicking the sign button is my legally binding electronic signature, with the same effect as a handwritten signature, under the federal ESIGN Act and Washington's Uniform Electronic Transactions Act, and I consent to receive my signed copy electronically.
